The government is adhering to Supreme Court’s order and hence Aadhar Card will not be a mandatory condition for citizens to avail benefits and subsidies. Therefore, individuals without Aadhaar number can offer alternate means of identification for availing the government subsidies, benefits and services.
Many government schemes are linked with Aadhar. This made the people without Aadhar card or the Enrolment slip feel that subsidies would be given only through Aadhar, and they would not be able to avail the benefits.
But this is not so as instead of Aadhar, one can easily present valid identification proof to prove one’s identity and avail the benefits under various government schemes.
Requirement of Aadhar Card Mandatory for availing subsidy and benefits is not needed
The government had introduced the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Bill 2016, in Parliament on March 3, 2016. And the Parliament passed it on March 16, 2016.
The President gave the assent to the Bill on March 25, 2016. On March 26, 2016, it published in the Official Gazette as Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016.
However, according to Section 7 of the Aadhar Act, in the absence of Aadhar, one can produce and valid ID proof. This
“Section 7 of the Aadhaar Act provides that if an Aadhaar number is not assigned to an individual, the individual shall be offered alternate and viable means of identification for delivery of the subsidy, benefit or service,”
– Minister of State for IT and Electronics P P Chaudhary informed the Lok Sabha.
However there are certain schemes for which Aadhar is mandatory and the same was also confirmed by the Supreme court’s ruling.
Aadhar Card Mandatory Schemes:
The apex court directed the government that Aadhar card will not be used for any purpose other than some schemes. These schemes are:
- PDS scheme
- Kerosene and LPG subsidy – more details
- National Social Assistance Programme pensions (old age, widow and disability pensions),
- PMJDY – more details
- NPS – more details
Till the court finally decides the matter, making Aadhar Card Mandatory will not be possible and no person will be denied benefits under any Government scheme for want of Aadhar card.
The court had made it clear that no one can discriminate between a person who has Aadhar card and one who does not. Therefore, individuals without Aadhar number can offer alternate means of identification, passport, voter id card, driving licence, etc. to avail the government subsidies, benefits and services.
